This Privacy Policy applies to all Howard Hughes Corporation websites and services that link to it, including and our mobile application (collectively, the “Website”). In addition, if you access and use the services on a mobile device and your mobile device’s settings allow it, we may collect information about your real-time location. We share your geolocation information with our developers who are contractually bound to only use this information as necessary to provide the services. How We Respond to Do Not Track Signals

Your web browser may let you choose your preference as to whether you want to allow the collection of information about your online activities over time and across different websites or online services. At this time, the Website does not respond to the preferences you may have set in your web browser regarding such collection of your information, and the Website may continue to collect information in the manner described in this Privacy Policy.

We may use the Personal Information we obtain about you to:

  • Respond to your questions and comments and provide customer or member support;

Summerlin Social Media Policy

Summerlin welcomes honest and open conversation on Summerlin and Downtown Summerlin social media pages (the “Summerlin Pages”); however, we reserve the right to remove comments or discussion posts at our discretion.

We encourage comments that:

  • Are on topic, brief, and have a constructive tone;
  • Are open to being discussed or even contradicted by other commenters; or
  • Might disagree with the content in the post or update.

We discourage comments that:

  • Are repeatedly off topic;
  • Are excessively long or negative in tone;
  • Are considered likely to disrupt, provoke, attack, or offend others, including personal conversations better suited for private messaging; or
  • Advertise products or services for profit or gain.

We reserve the right to remove comments that:

  • Are racist, sexist, sexually explicit, abusive or otherwise objectionable;
  • Contain swear words or other language likely to offend;

By commenting on the Summerlin Pages, you are indicating that you have read, understand, and agree to abide by the guidelines laid out above. People who are continually abusive and offensive to others on the Summerlin Pages risk being permanently removed as commenters.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN IN THIS COMPETITION and a purchase will not increase your chances of winning.  The Summerlin Photography Competition (the “Contest”) is open is open to all legal residents of the United States who are eighteen (18) years of age or older.  Void where prohibited by law.  Individuals employed by (i) Howard Hughes Corporation (“Sponsor”); (ii) Downtown Summerlin vendors, retail tenants, or licensees; or, (iii) Sponsors’ affiliates or subsidiaries, or its advertising and marketing agencies; and such employees’ immediate families, may not enter or participate in the Contest.  Immediate family members are defined as a parent, spouse, sibling, child or anyone sharing the same residence as the applicable employee.  By participating, entrants agree to be bound by these Official Rules as may be modified or amended by Sponsor, and the decisions of the Sponsor, which are final and binding.  The Sponsor reserves the right, in its sole and absolute discretion to cancel, discontinue, terminate or modify the Contest in whole or part.

  1. Contest Period: The Contest begins on June 1, 2022, at 12:00 PM PDT and concludes on August 31, 2022 at 5:00 PM PDT (the “Contest Period”).  All entries must be submitted within the Contest Period.  Entries received after the end of the Contest Period will be void. 
  2. How to Enter:  To enter the Contest, individuals must visit and complete the Summerlin Photography Competition Form.  Information provided in connection with entrance into the Contest may be used by Sponsor in accordance with its Privacy Policy, which is found at and which may be updated from time to time.  In case of dispute as to the identity of any entrant, each entry will be deemed made by the Authorized Account Holder (as defined below) of the email address used to enter the Contest.  “Authorized Account Holder” is defined as the natural person who is assigned to an email address by an Internet service provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.  Any potential winner may be requested to provide Sponsor with proof that such winner is the Authorized Account Holder of the email address associated used to enter the Contest.  By entering this Contest, entrants give their express permission to be contacted by Sponsor by email for any purposes.     
  3. Entry Guidelines and Restrictions:  Each entrant may submit a maximum of one digital photograph in each of the following Contest Categories:
  • Architecture
  • Natural Landscapes
  • Man-made landscapes

(each photograph an “Entry”).  Entries must comply with the following requirements and restrictions:

  • Entries must have a resolution of at least 300DPI. 
  • Each Entry must have been taken within Summerlin or the adjacent Red Rock Canyon National Conservation Area/Spring Mountain area. 
  • Entries may not contain images of people or domesticated animals. 
  • Each Entry must be original and created solely by you, and may not be plagiarized;
  • Entries must not contain material that violates or infringes upon any rights of any other party, including, but not limited to, copyright, trademark, privacy, publicity, or any other intellectual property rights;
  • Entries must not in any way disparage Sponsor or any other person, entity, company, or party;
  • Photographs must not contain material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous, or libelous;
  • Entries must not contain material that promotes bigotry, racism, hatred, or harm against any group or individual, or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age;
  • Entries must not promote illegal drugs or firearms, or the use of any of the foregoing, or any activities that may appear unsafe or dangerous, and must not promote any particular political agenda or message; and
  • Entries must not contain material that is unlawful, in violation of, or contrary to the laws or regulations of the United States or the State of Nevada.
  • Entrants must comply with all applicable federal, state, and local statutes, codes, ordinances, and/or regulations, in taking their Entry photographs.

By submitting an Entry, you agree that your Entry conforms to the requirements set forth above and that Sponsor may, in its sole and absolute discretion, disqualify you from the Contest if Sponsor determines that your Entry fails to conform to the such requirements or any other provision of these Official Rules.

4. Failed Entries; Disqualification:  Sponsor, including its directors, officers, employees, and agents, affiliates, and any third-party providers of services or goods are not responsible for incorrect or inaccurate entry information, or for any human mistake, technical error, or for lost, late, misdirected, unintelligible, returned or undelivered entries, telephone calls, or emails, or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website, or other connections availability, accessibility or for traffic congestion, miscommunications, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network.  Persons who tamper with or abuse any aspect of this Contest, or act in violation of the Official Rules, or act in any manner to threaten, abuse or harass another entrant, as solely determined by Sponsor, may be disqualified in Sponsor’s sole and absolute discretion. Entry materials that have been tampered with or altered are void.  Any attempt to deliberately damage the content or operation of this Contest is unlawful and subject to legal action by Sponsor.  Sponsor is not responsible for printing or typographical errors or problems in any materials related to the Contest.

5. Selection of Winners:  Following the close of the Contest Period, Sponsor will review the Entries submitted by each entrant.  In its sole and absolute discretion, and subject to further verification and compliance with these Official Rules, the Sponsor will select one Grand Prize Winner and one Runner Up Winner (collectively, “Winners”) in each of the three Contest Categories.  Entrants NEED NOT BE present at the TIME OF SELECTION to win.  In selecting the Winners, Sponsor may utilize a panel of professional and amateur photographers to evaluate the merits and quality of each Entry, as well as the Entry’s conformance with the Entry Guidelines and Restrictions. Notwithstanding the foregoing, Sponsor shall have sole judgment and control over every aspect of the Contest and Sponsor’s decisions on all matters related to the Contest shall be final and binding in all respects.  Sponsor’s decisions on all matters related to the Contest shall not be subject to challenge or appeal and such decisions shall not be subject to any limitation whatsoever, except for any limitations imposed by law.  Sponsor reserves the right to establish and modify, in its sole judgment and at any time, the procedures and/or standards it will utilize for selecting the Winners. Entrants may only win in one Contest Category.

6. Winner Notification:  Sponsor will notify each of the Winners through the email address associated with the Entry into the Contest.  Any Notification Email returned to Sponsor or its agencies as undeliverable will result in disqualification. To claim the prize, each Winner must respond to the Notification Email and provide their (1) name; (2) mailing address; and (3) verification that they are 18 years or older.  No other party will be allowed to claim the prize on a Winner’s behalf.  If a Winner does not contact Sponsor by 5:00 PM PDT on September 16, 2022, the prize will be forfeited and a new Winner may be selected by the Sponsor, in its sole and absolute discretion.  The Winner may be required to provide identification and sign an affidavit acknowledging the award; the prize will only be awarded to a verified Winner.  If a Winner refuses to execute the required documents or rejects his/her prize, or in the event of noncompliance with these Official Rules, the prize will be forfeited and a new Winner may be selected by the Sponsor, in its sole and absolute discretion.

7. Prize:  Each Grand Prize Winner will receive a $250.00 Downtown Summerlin gift card and a professionally printed copy of winning photo (Actual Retail Value: $500.00), and each Runner Up Winner will receive a $50.00 Downtown Summerlin gift card (Actual Retail Value: $50.00) (each a “Prize”).  Each Winner will also have their winning Entry displayed at Festival of Arts on October 8-9, 2022 and highlighted as a winner in the Contest.  All taxes and fees and associated with using any Prize are the sole responsibility of each Winner.  The Prizes are not transferable and not redeemable for cash except at the sole discretion of Sponsor.  In the sole discretion of Sponsor, each Prize is subject to change without notice, but will be substituted with a prize of equal or greater ARV.  The Prizes are awarded “as is” with no warranty or guarantee by Sponsor.

8. Taxes:  ALL FEDERAL, STATE, AND LOCAL TAXES ASSOCIATED WITH THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER.  Winner will receive a 1099 tax form, when applicable, provided by Sponsor.

Indemnification and Liability Release:  By participating in this Contest and/or by accepting any Prize that you may be awarded, you agree to defend, indemnify and hold harmless the Sponsor and its respective parents, subsidiaries and affiliated companies, units and divisions; and their advertising and promotional agencies and Prize suppliers; each of their respective officers, directors, agents, representatives and employees; and each of these company’s and individual’s respective successors, representatives and assigns (collectively, the “Indemnified Parties”) against any and all actions, claims (including any third party claims) injury, loss or damage arising in any manner, directly or indirectly, from or relating to this Contest, including entry and participation in this Contest, or the acceptance, possession, use or misuse of any Prize. By participating in the Contest and/or accepting any Prize that you may be awarded, you agree to release, discharge, indemnify, and hold harmless the Indemnified Parties from any and all liability for loss, harm, damage, injury, cost, or expense whatsoever, including, without limitation, property damage, attorneys’ fees, personal injury and/or death that may occur in connection with preparation for, travel to, or participation in this Contest, or possession, acceptance, delivery, misdelivery, use, misuse or inability to use the Prize, or participation in any Contest-related activity, and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement, right of publicity, or any other intellectual property-related cause of action, whether intentional or unintentional, whether under a theory of contract, tort (including negligence), warranty, or other theory.

9. Trademarks:  The trademarks of The Howard Hughes Corporation and Downtown Summerlin are the property of the owners of such trademarks.

10. Publicity; Use of Personal Information: Except where prohibited by law, entrance into the Contest grants Sponsor and its affiliates, agents, successors and assigns a royalty-free, fully paid, non-exclusive, sublicensable, transferable, irrevocable, perpetual, unrestricted, worldwide license to use, publish, transmit, display, store, distribute, your Entries, your name, likeness, photograph, voice, biographical information, prize information, hometown, and state for promotional purposes in any media whatsoever. Sponsor will not be required to pay any additional consideration or seek any additional approval in connection with such uses.  Sponsor is not obligated to use any of the above-mentioned information, but may do so and may edit such information or materials, in Sponsor’s sole discretion, without further notice obligation or compensation, unless prohibited by law. Sponsor may require each Winner to execute a written consent containing this right of publicity. 

11. Entrant Acknowledgements; General Waivers; Waiver or Right to Class Action:  By entering this Contest, entrants agree that (i) they have read and accepted these Official Rules; (ii) Sponsor may terminate, postpone or otherwise modify the Contest at any time in its sole and absolute discretion including, without limitation, in the event of equipment failure or malfunction, acts of God, natural causes, labor disputes, or fire, flood or other casualties; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys’ fees; and, (iv) under no circumstances will any entrant be permitted to obtain any award for, and entrants hereby waive all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages other than actual out-of-pocket expenses.  BY ENTERING THIS CONTEST, EACH ENTRANT HEREBY WAIVES ANY RIGHT TO PROCEED BY WAY OF A CLASS ACTION, TO SERVE IN ANY REPRESENTATIVE CAPACITY FOR OTHERS, AND TO ACT AS A PRIVATE ATTORNEY GENERAL IN ANY CLAIM OR CONTROVERSY ARISING OUT OF OR RELATING TO THIS CONTEST OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION OR VALIDITY THEREOF.  Some jurisdictions do not allow for limitations on the ability to pursue class action remedies or certain kinds of damages, and so these limitations may not apply to you.

12. Governing Law; Venue: Except where prohibited, each entrant agrees that: (i) all issues and questions concerning these Official Rules shall be governed exclusively by Nevada law without giving effect to any principles of conflicts of law of any jurisdiction; (ii) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Contest or any prize awarded shall be (A) resolved individually, without resort to any form of class action; and, (B) filed only in the state or federal courts situated in Clark County, Nevada, and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and, (iv) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

13. Severability: The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
